EXAMPLES  OF THE INJUSTICES OF THIS DEMARCATION

When we say that this demarcation of the coastline is unfair, we are referring to the following cases:

How can we explain that one building is considered public land and a neighbouring building isn’t,  if both are constructed on the same type of land? Case study: the Restaurant Real Playa and the neighbouring Talaya Apartments.

How can we justify categorising the area of coastline houses built more than 150mts from the coast as public land? (along a coast of rocks). Case study: Espalmador Apartments or Lago Playa Bungalows (both in Sa Roqueta)…

How is it possible that a hotel built on a former quarry (of rocks) is now considered as built on sand dunes?Case study: the Roca Bella Hotel and Cafeteria Zulmar in Es Pujols…

With what authority does the Coast Department ignore the urban planning of Formentera’s Main Town Hall? Case study: Hostal Sa Roqueta has been considered an urban area of public land according to local urban regulations since 1989…

Why all large hotels of the island that are built on the coast have not being officially identified as public land even when one of them is located in an area classified as “rural? Case study: the Hotel Formentera Playa in Ca Marí…

How can anybody justify a property winning this legal demand for having centenary trees when so many other properties include the same type of vegetation and no such consideration has been marked for those properties? Case study: the property of  José A. Trevijano in Es Caló…

How do we explain the Formentera Main Town Hall awarding a licence to build a restaurant, which is then completed, receiving the additional authorisation of the Environment Ministry (executed by the Coast Department) and which, shortly afterwards, is identified in the coast demarcation as public land? Case study: Benito Ferrer, the owner of the Restaurant Es Codol Foradat in Migjorn.

How is is possible that from the more than 50 cases presented to  Court, only 2 or 3 have been victorious and that the Coast Demarcation is now presenting again the same demarcation for those areas but with new allegations?
